1. Introduction

By using Soberly, you confirm your acceptance of, and agree to be bound by, these terms and conditions.

2. Agreement to Terms and Conditions

This Agreement takes effect on the date you first use the Soberly application.

3. License and Termination Rights

The Soberly app is provided solely for personal use to support and track your sobriety journey. You may use the app’s functionalities as provided, subject to these terms. Soberly retains the right to terminate or restrict your access to the app at any time without prior notice. This enables Soberly to ensure responsible and appropriate usage of the app.

4. Refunds

Soberly offers subscription-based premium features, including weekly, monthly, annual, and lifetime plans. As digital products, all purchases are final and non-refundable except where required by applicable consumer protection laws. Refund requests must be submitted through the respective app store (Apple App Store or Google Play Store) in accordance with their refund policies.

Lifetime purchases are one-time payments granting access for the duration of the Soberly service (see Section 5 for details). No partial refunds will be provided for lifetime purchases.

5. Subscription Terms

5.1 Subscription Types

Soberly offers the following subscription options, all granting access to Soberly Pro premium features:

  • Weekly: Recurring subscription billed every week
  • Monthly: Recurring subscription billed every month
  • Yearly/Annual: Recurring subscription billed every year
  • Lifetime: One-time purchase granting permanent access

All subscription tiers provide the same premium features and entitlements.

5.2 Recurring Subscriptions (Weekly, Monthly, Yearly)

  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel your subscription at any time through your device’s App Store or Google Play account settings.
  • Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date.
  • No refunds or credits will be provided for partial subscription periods.

5.3 Free Trials

  • Some subscriptions may include a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
  • Free trials are limited to one per user/account. Creating multiple accounts to obtain additional trials is prohibited and may result in account termination.

5.4 Lifetime Subscription

  • A “Lifetime” subscription is a one-time purchase providing access to Soberly Pro premium features for the operational lifetime of the Soberly service.
  • Important: “Lifetime” refers to the lifetime of the Soberly service, NOT the personal lifetime of the subscriber. Your access continues for as long as Soberly continues to operate and maintain the service.
  • Lifetime purchases are final and non-refundable.

5.5 Service Continuity

Soberly reserves the right to modify, suspend, or discontinue the service (or any part thereof) at any time. In the event of permanent service discontinuation:

  • Active subscribers (weekly, monthly, yearly) will not be charged for future billing periods.
  • Lifetime subscribers will receive at least 30 days’ advance notice where practicable.
  • Soberly shall have no obligation to provide refunds for any remaining subscription period or lifetime purchases in the event of service discontinuation.

5.6 Feature Scope

All subscription tiers include access to premium features available at the time of purchase. Future features and updates may be included at Soberly’s discretion. Soberly reserves the right to modify, add, or remove features as the service evolves, provided core premium functionality is maintained.

5.7 Non-Transferability

All subscriptions are personal to you and non-transferable. They are tied to your account and cannot be shared, sold, or transferred to another person or account.

5.8 Price Changes

Soberly may change subscription prices at any time. Price changes for recurring subscriptions will take effect at the start of the next billing period following notice of the change. If you do not agree with the new price, you may cancel your subscription before it renews.

6. Disclaimer

Soberly does not warrant that the app will meet your specific requirements or that its operation will be uninterrupted or error-free. All express and implied warranties or conditions not expressly stated in this Agreement, including but not limited to loss of data or any interruption of service, are excluded to the maximum extent allowed by law. This Agreement does not affect your statutory rights.

7. Warranties and Limitation of Liability

Soberly does not provide any warranty, guarantee, or other terms regarding the app’s quality, suitability for any purpose, or functionality. Soberly is not liable for any indirect, special, or consequential losses or damages arising from the app’s use. Should Soberly be deemed liable for a breach of this Agreement, you agree that any liability will be limited to the amount actually paid by you for any paid features or services in the app, if any. You hereby release Soberly from any and all obligations, liabilities, and claims beyond this limitation.

8. Responsibilities

Soberly is not responsible for any actions taken by users based on their personal sobriety tracking data generated within the app.

9. Price Adjustments

Soberly is committed to improving the app. Subscription pricing may be adjusted at any time. Existing subscribers will be notified in advance of any price changes that affect their renewal rates.

10. General Terms and Law

This Agreement is governed by the laws of South Africa. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and Soberly as a result of your use of these services. You agree not to represent yourself as a representative, agent, or employee of Soberly and acknowledge that Soberly is not liable for any act or omission by you.

11. AI Sobriety Coach/Companion (Beta)

  1. Nature of the Feature

    • The AI Sobriety Coach/Companion (the “AI Feature”) allows users to engage in supportive conversations related to sobriety and well-being. This feature is currently in beta and may change over time.
  2. No Medical or Therapeutic Advice

    • The AI Feature offers general information and guidance only. It does not replace professional medical, psychological, or therapeutic advice. Always consult a qualified professional if you need specific assistance or guidance.
  3. Use of Third-Party Services (Groq)

    • By using the AI Feature, you acknowledge and agree that Soberly may rely on third-party services, such as Groq, to process data and generate responses.
    • Your use of the AI Feature may therefore be subject to Groq’s Privacy Policy and other applicable terms of Groq. We encourage you to review Groq’s policies to understand how they handle and protect user data.
    • Soberly does not control or assume responsibility for any third-party terms, policies, or services.
  4. User Responsibility

    • You are responsible for any actions or decisions made based on interactions with the AI Feature. Soberly is not liable for consequences resulting from reliance on AI-generated content.
  5. Beta Disclaimer

    • As a beta feature, the AI Coach/Companion may experience interruptions, delays, or errors. Soberly makes no guarantees regarding the performance or accuracy of the AI Feature and reserves the right to modify or discontinue it at any time.
