Privacy Policy

Your privacy is important to us. It is Soberly’s policy to respect your privacy regarding any information we may collect from you within our mobile app and any other platforms we operate.

1. Information Collection and Use

We only ask for personal information when it is essential for providing our services. When you sign in with Google, your Soberly account will be pre-filled with your name and profile picture. We collect information by lawful and transparent means, with your knowledge and consent, and we will explain why we are collecting it and how it will be used.

2. Data Retention

We retain collected information only for as long as necessary to provide you with your requested services. We securely store any data we retain to protect it against loss, theft, unauthorized access, disclosure, copying, use, or modification.

3. Data Sharing

We do not share any personally identifying information publicly or with third parties, except as required by law. Certain functionality within our AI Sobriety Coach/Companion feature (in beta) may rely on Groq or other service providers to process data you provide. Any sharing of data with these third parties is strictly for the purpose of delivering the requested service.

The Soberly app may contain links to external sites that are not operated by us. Please be aware that we have no control over the content or privacy practices of these sites and cannot accept responsibility or liability for their privacy policies.

5. AI Sobriety Coach/Companion (Beta)

  1. Nature of the Feature: The AI Sobriety Coach/Companion allows users to engage in supportive conversations regarding sobriety and related well-being topics. This feature is provided on a beta basis, meaning functionality and underlying technologies may change over time.
  2. Data Processing: Conversations or requests you make to the AI Coach/Companion may be transmitted to our third-party service provider(s), such as Groq, solely to process and return appropriate responses.
  3. Third-Party Privacy Policy: By using this AI feature, you acknowledge and agree that data processing may be subject to Groq’s Privacy Policy. We recommend reviewing their policy to understand how they handle and protect your data.
  4. Data Usage: Data collected through the AI feature is used to provide, maintain, and improve our AI functionality and overall service. We do not use your personal information or conversation content for advertising or marketing purposes.
  5. User Consent and Control: Your use of the AI Sobriety Coach/Companion is entirely voluntary. If you do not consent to having conversation data processed by third parties, please refrain from using this feature.

6. Your Choice

You are free to refuse our request for personal information, understanding that this may prevent us from providing some features of the app. Likewise, you may choose not to use the AI Sobriety Coach/Companion. However, opting out of this feature may limit your ability to receive certain AI-based support within the app.

7. Legacy User Data Processing (Soberly V1)

If you previously used Soberly V1, we may process certain data from your former account to inform you about the launch of Soberly V2 and provide you with a premium offer code as a token of appreciation for your past support.

What data we process:

  • Email addresses of former Soberly V1 users
  • Account creation dates for internal record-keeping only

We do not extract or process any health data, sobriety tracking metrics, or other sensitive personal information from V1 accounts.

Why we process it: We process this data for a one-time notification about the Soberly V2 launch and to provide a premium offer code to former users who supported our initial version.

Legal basis: We process this data based on our legitimate interest in maintaining an existing customer relationship. You can object to this processing at any time using the unsubscribe mechanism in any email we send.

Third-party processors: We use Loops.so as our email delivery service provider for campaign management and delivery. We only share email addresses with Loops.so for this purpose. You can review their privacy policy at https://loops.so/privacy. We have a Data Processing Agreement in place with Loops.so as required for GDPR compliance.

Data retention:

  • Campaign email lists are deleted within 30 days of campaign completion
  • Opt-out and unsubscribe records are retained permanently for compliance purposes
  • If you opt in to V2 communications, your data is retained according to the data retention policies described in Section 2 of this privacy policy

Your rights: You have the right to:

  • Unsubscribe from campaign emails via the one-click link included in every email
  • Request access to your V1 email data we have on file
  • Request deletion from the campaign email list
  • Object to processing at any time by contacting us

If you wish to exercise any of these rights, please contact us or use the unsubscribe link in our emails.

8. Acceptance of Policy

By continuing to use the Soberly app, you accept our practices regarding privacy and personal information, including the use of the AI Sobriety Coach/Companion feature as described above.
